Rhode Island’s ruling on website design fees

In Declaratory Ruling 2023-01, the Division of Taxation found that one company’s “consulting, startup, website design, and transaction fees are subject to Rhode Island sales and use tax,” reasoning that the websites it designed for customers “are not custom software, but rather are SaaS, which is taxable.” The ruling answers one taxpayer’s facts, an employee recognition program, and we read a 2026 archived copy. It does not say every website is taxable.

It does show the question to ask. If your agency’s site runs on its own platform and you pay monthly to use it, ask whether Rhode Island sales tax applies. If it is a site you own outright, ask why it would not, and put the answer in writing. For a real amount, ask the Division or your accountant. The Secretary of State’s corporate database can confirm a legal name.

Does paying monthly make a website taxable?

Not automatically, but the ruling above treated a platform-style arrangement as software as a service. Ask each firm which kind of arrangement yours is.

Are the published prices comparable?

Only partly. Black Door’s starting price and JPG’s typical range describe different things, and both have separate care plans or maintenance. Ask both to quote the same page count.
